Is it really too much to ask that the Tories provide a little bit of detail on these points?Tim Jhttps://www.blogger.com/profile/03705980028580424584noreply@blogger.comtag:blogger.com,1999:blog-21724748.post-1151883490867915252006-07-03T00:38:00.000+01:002006-07-03T00:38:00.000+01:00Tim,"The Human Rights Act is deeply flawed, not in...Tim,

"The Human Rights Act is deeply flawed, not in concept but in execution. It takes a continental legal concept, and superimposes it on a Common law system. What Cameron is proposing might be a remedy to this. It might of course be nothing more than a cheap stunt, but the possibility remains that it is instead a workable solution to an identifiable problem."

This is a worthy analysis. Worthy, Tim, even of you. However, it is so worthy that it ends up shooting itself in the foot.

Here's why: if this WASN'T a cheap stunt, Cameron would have laid out, very clearly, the argument you put forward.

This would also give him a huge leg up in a whole series of other issues: he simply has to make clear that there is a huge disconnect between continental legal systems and our common law system.

The very fact that he has failed to do this - focussing on the HRA itself, rather than the problem of implementing it into common law - does indeed show that this is just a cheap stunt.

I despair sometimes. Cameron could be so good. He could open up so much clear blue water, but he just seems to flounder about.

Gaaah!The Pedant-Generalhttps://www.blogger.com/profile/08738418480281658868noreply@blogger.com
